Marshall Website Terms of Use

These terms set out the basis on which you can visit and use the Marshall website at www.marshall.co.uk , all associated webpages or sites and any applications operated by Marshall (collectively, the Site). Please read them carefully as they contain important information. By using our Site, you agree to be bound by these terms. If you do not agree to them, please do not use the Site.

We may change these terms at any time without notice. The revised terms will be made available on the Site. Your continued use of the Site will constitute your acceptance of the amended terms.

Our Privacy Notice also applies to your use of the Site and sets out how we use and protect personal information about you and our use of cookies on the Site.

If you buy a vehicle or any services from, or sell a vehicle to, Marshall through or on the Site, the relevant Marshall terms and conditions shall apply to that transaction.

Who we are

1. The Site is owned and operated by or on behalf of Marshall Motor Group Limited ('Marshall', 'we' or 'us'). Registered office: c/o Marshall Volkswagen Milton Keynes, Greyfriars Court, Milton Keynes, Buckinghamshire MK10 0BN. Registered number: 00295579 (England and Wales).

Using the Site

2. Subject to these terms, you are authorised to view and download the Site for your personal use only. The Site is not free to copy or re-use.

3. You agree not to use the Site, any part of it or any data obtained from it (such as valuations of vehicles for sale or part-ex vehicles or car finance credit scores) for any commercial or business purposes. You may not copy significant parts of, extract, “scrape”, trawl, data-mine, reverse engineer, mirror, adapt, re-publish, re-use, or use commercially any content, ads, information, data, output, or offers that we publish on any part of the Site, including information such as valuations of vehicles for sale or part-ex vehicles. You cannot create any hypertext links, frames, embedding, or any other links between the Site and your site or app or any other site or app without our permission. You also cannot use our Site to create, check, confirm, update, modify or amend your own or another person's databases, records or directories. You also cannot use automated software programs or robots to do any of the activities listed in this paragraph.

4. We continuously monitor the use of our Site and use technology to inform us of any improper or commercial use or other breaches of these terms. If we identify any improper or commercial use of the Site by you or if you are using our Site for unauthorised purposes or in breach of these terms, we (and our licensors) reserve our rights to take such action against you as we (or our licensors) see fit, which may include legal proceedings.

5. If you create an account, then you must keep your login and password details secret and not allow anyone else to use them. You will be responsible for any use of your account whether by you or anyone else.

6. You must not upload to your account or any part of the Site anything that is in any way illegal, objectionable or contrary to Marshall’s policies, or harmful (such as viruses or malware), or that breaches any third party’s rights or any law.

7. We can cancel or suspend your access to the Site at any time for any reason, but in particular if you have not respected any of these terms, or any instructions or policies that we issue from time to time. You can cancel your account at any time by telling us or by logging in and following the process indicated.

8. Marshall may change, suspend or discontinue the Site at any time, including the availability of any feature, database, or content. Marshall may also impose limits on certain features and services or restrict your access to parts or all of the Site without notice or liability.

Ownership of rights

9. All rights, including copyright, in the Site and all its contents, including trademarks, symbols and slogans, text, data, databases, still or moving images, audio-visual content, graphics or layout, whether or not registered, are owned by Marshall or its licensors (in particular CAP HPI data is protected by copyright and database rights with all rights reserved to CAP HPI and third party trademarks may be used to identify the manufacturers of cars and other third party service providers (such as lenders) and are owned by those third parties). Any use of the Site or its contents, including copying, adapting, publishing or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Marshall. You may not modify, distribute or re-post something on the Site for any purpose.

Accuracy of content

10. Marshall has taken every care in the preparation of the content of the Site. To the extent permitted by applicable law, Marshall disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on the Site. Marshall shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the content on the Site.

Privacy, your personal data and cookies

11. The privacy of your personal data is important to us. Please see our Privacy Notice for details of how we will process your personal data and for details about how we use cookies on the Site.

Third party sites

12. The Site and/or the materials on it may contain links to third party websites, services or applications. Your browsing and interaction on any other website, including websites which have a link to the Site, is subject to that website’s own rules and policies including in relation to privacy. Please read those rules and policies before proceeding.

13. If you decide to visit any third party website or resource, you do so at your own risk. We are not responsible for the content, accuracy or opinions expressed in such websites or for any services or products accessed via any such websites. Links do not imply that we are, or the Site is, affiliated to or associated with such sites.

14. The inclusion of any link in our communications with you does not imply endorsement by us of the linked website or third party. If you decide to access linked third party websites, you do so at your own risk.

15. Please remember that when you use a link to go from the Site to another website, these terms and our privacy notice, are no longer in effect. Your browsing and interaction on any other website, including websites which are linked to ours, is subject to that website’s own rules and policies.

Our liability

16. To the maximum extent that the law permits, we exclude all liability whether for breach of contract, non-contractual liability or any other cause of action, for any matter arising out of or in connection with:

  • your use of, or inability to use, the Site;
  • any transaction that may be conducted through or on the Site (except to the extent set out in any applicable terms that apply to such a transaction);
  • any loss caused as a result of your actions or inactions based on the content of the Site;
  • your use of websites linked from the Site; or
  • booking, arranging, cancelling or attending any appointment with us.
  • 17. In particular, we will not be liable for:

  • any economic losses (e.g. loss of revenues, profits, contracts, business or anticipated savings);
  • any loss of business opportunity, goodwill or reputation;
  • damage to any device or digital content; or
  • any indirect or consequential losses.
  • 18. We will not be liable for any loss or damage arising due to any event outside our control. However, we do not limit or exclude our liability for death or personal injury resulting from our negligence, for fraud or fraudulent misrepresentation, or any for anything else than may not be limited or excluded under applicable law and, where you are acting as a private consumer, nothing in these terms shall affect your statutory rights.

    19. We will use reasonable care and skill in providing the Site, but the Site is provided on an "as is" and "as available" basis without any other representation, endorsement or warranties of any kind. We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components. Any terms that would otherwise be implied by law, course of dealing or custom, are also excluded to the extent permitted by law. For clarity, all warranties of non-infringement, satisfactory quality, fitness for a particular purpose, compatibility, accuracy, availability, or being up to date or complete, are excluded to the extent permitted by law.

    20. When you are buying or selling a vehicle or using another of our services, please refer to the applicable terms for that transaction for information in relation to our liability to you in respect of that transaction.

    Legal compliance and applicable law

    21. These terms shall be governed by the laws of England and Wales and any matter or dispute arising in connection with them and your access to and use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.

    22. You are responsible for compliance with applicable local laws relating to the use of or otherwise connected with the Site. To the extent that the Site or any activity contemplated by it would infringe any law of a jurisdiction other than England, then you are prohibited from accessing or using the Site or attempting to carry on any such offending activity and this provision shall override all other provisions of these terms.

    General

    23. If any provision of these terms is or becomes illegal, invalid or unenforceable, that does not affect the legality, validity or enforceability of the other provisions.

    24. These terms are the legal agreement for use of the Service and override any other discussions, documents, and anything indicated on the Site or by a customer service agent, or in any other way.

    25. We can transfer our agreement with you to another party. We may do this in particular to a buyer of our business, a business that we merge with, or to another company in the Constellation Automotive Group of companies.
